29 CFR 1926.452(w)(2):Scaffold casters and wheels shall be locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold is used in a stationary manner. a) On or about 05/13/2022, at the former "Bar 145" undergoing renovations, located at 71 Celebration Drive - College Town in Rochester, New York, the employer did not enforce the use of wheel locks when employees were performing drywall work. The employer allowed employees to use mobile scaffolds in a stationary manner without locking the wheels. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step. a) On or about 05/13/2022, at the former "Bar 145" undergoing renovations, located at 71 Celebration Drive - College Town in Rochester, New York, the employer did not enforce the safe use of step ladders. The employer allowed employees to use top steps of a step ladder while performing drywall work. NO ABATEMENT CERTIFICATION REQUIRED
