29 CFR  1926.300(b)(2): Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating or moving parts of equipment were not guarded when such parts were exposed to contact by employees or otherwise create a hazard:  (a) Lopez Construction LLC at 1333 North Elk Vale Road, Rapid City, SD 57703:  On or about and at times prior to May 11, 2022, the employer did not ensure that employees were protected from contact with unguarded belt and pulley on a gas-powered air compressor.  This condition exposed employees to caught-in and amputation injuries.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) Lopez Construction LLC at 1333 North Elk Vale Road, Rapid City, SD 57703:  On or about and at times prior to May 11, 2022, the exposing employer did not ensure that employees were properly trained on the use of fall protection systems prior to being exposed to fall hazards while working on a low-slope commercial roof.  This condition exposed employees to fall hazards greater than 6 feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) Lopez Construction LLC at 1333 North Elk Vale Road, Rapid City, SD 57703:  On or about and at times prior to May 11, 2022, the exposing employer did not ensure that the ladder being used for access to the first level roof on the south side work area of the low-slope commercial property was extended at least three feet above the upper landing surface.  This condition exposed employees to fall hazards associated with ladder access.

(a) Lopez Construction LLC at 1333 North Elk Vale Road, Rapid City, SD 57703:  On or about and at times prior to May 11, 2022, the exposing employer did not ensure that employees were properly trained on the use of  extension ladders being used on site to access the upper work surfaces of the roof of the low-slope commercial property for roofing operations.  This condition exposed employees to fall hazards associated with improper ladder use.
