OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and fall hazards while standing within the swing radius of a John Deere 410L Backhoe Loader bucket at the edge of an excavation: (a) Jobsite at Potters Avenue and Cahill Street in Providence, RI: On or about May 16, 2022, the employer did not ensure that employees were outside of the swing radius of the John Deere 410L Backhoe Loader before the backhoe bucket was moved which struck an employee and pushed him into the excavation causing him to fall into and strike the edge of the excavation.
