29 CFR  1903.19(d)(1):The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  The employer did not certify and provide documentation of the corrective actions taken for the hazards identified in violations 1-1 and 2-2 of this inspection which address protective helmets and fall protection training, respectively.

29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about May 16, 2022, at a jobsite located at N1673 Municipal Road, Greenville Wisconsin, an employee was exposed to struck by hazards from falling tools and construction debris while conducting cleaning activities below the roofline without an form of head protection.

29 CFR  1926.501(b)(11): "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.   Hector Hernandez dba Town City Construction does not require the use of fall protection when employees are exposed to fall hazard. This was most recently observed on May 16, 2022, at a commercial worksite located at N1673 Municipal Road, Greenville Wisconsin, when six employees and the supervisor were exposed to a fall hazards of approximately nine feet and a roof pitch of 4.5:12  and greater while removing old shingles and installing new shingles on a commercial building having a steep pitch roof without fall protection.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   Hector Hernandez dba Town City Construction does not provide fall protection training to employees who are  exposed to fall hazards greater than six feet while re-roofing an existing commercial business. This was most recently observed on May 16, 2022, at a commercial worksite located at N1673 Municipal Road, Greenville Wisconsin, when five employees who were not provided fall protection training by the employer were exposed to a fall hazards of approximately nine feet while removing old shingles and installing new shingles on a commercial building having a steep pitch roof without fall protection.
