29 CFR  1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling:  On or about May 13, 2022, the employer at 2421 Morral Kirkpatrick Road in Morral, Ohio failed to install effective fall protection for employees in the wash bay area when employees first get on top of the tanker trucks approximately 10 feet or higher and when they serve as hole watch for employees cleaning the inside of the tanker truck. Falls of 10 feet or greater can cause serious injuries and possibly death if an employee falls off the side of the truck.

On or about May 13, 2022, the employer at 2421 Morral Kirkpatrick Road in Morral, Ohio failed to maintain the eyewash station to provide a continuous flow of water able to flush out an employee's eyes in the event that the employee is exposed to corrosive chemical products, such as sodium hydroxide, while cleaning out tankers using the pressure washers or setting up containers of said chemical product in the storage area.

On or about May 13, 2022, the employer at 2421 Morral Kirkpatrick Road in Morral, Ohio failed to provide labels for chemical products in opened secondary containers. These containers held cleaning products, some identified as corrosive, that contained chemical ingredients including but not limited to Sodium Hydroxide, Sodium Silicate, and Longchain Alcohol Alkoxylated. These products were used in the workplace for tanker truck cleaning operations exposing employees to these chemicals when installing the chemicals into the mixing system and when spraying the chemicals using a pressure washer.
