29 CFR 1910.178(l)(1)(i): Power industrial trucks. Operator training. Safe operations. The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a) On or about May 16, 2022, the employer did not ensure that his employees were trained to operate a powered industrial trucks such as Genie-S60 Articulated Boom-Lift at a new construction jobsite.

29 CFR 1926.453(b)(2)(v): Aerial Lifts. Specific requirements. Extensible and articulating boom platforms. A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a) On or about May 16, 2022, two employees were exposed to a 55 ft. fall hazard while operating an articulating boom platform to conduct carpentry and framing work on a commercial building without a fall protection system in place.

29 CFR  1926.501(b)(15): "Walking/working surfaces not otherwise addressed." Except as provided in 1926.500(a)(2) or in 1926.501 (b)(1) through (b)(14), each employee on a walking/working surface 6 feet (1.8 m) or more above lower levels shall be protected from falling by a guardrail system, safety net system, or personal fall arrest system.   a) On or about on May 16, 2022, an employee was working on the lower level roof of a new commercial property.  Employee was not utilizing any conventional fall protection system, while working above 16 ft. from the ground.

29 CFR  1926.503(a)(1):Training program. The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) On or about May 16, 2022, employees have not been adequately trained on fall protection systems and on hazards of falls, in that employees were working on a lower-level roof with no conventional fall protection system in place. The fall hazard was calculated at 16 ft. from the ground.
