29 CFR 1910.1026(i)(4)(i): Whenever the employer allows employees to consume food or beverages at a worksite where chromium (VI) is present, the employer did not ensure that eating and drinking areas and surfaces are maintained as free as practicable of chromium (VI): a) On or about May 18, 2022, and at times prior, the employer allowed employees to drink at the work bench area outside the spray booth. Wipe samples taken of the work bench results showed 20.326 ug and the work bench chair showed 3.881 ug. Wipe sample results for the breakroom and bathroom surfaces showed 0.154 ug to 0.157 ug.

Wipe samples taken of the work bench showed chromium (VI) levels at 20.326 ug and the chair at that work bench at 3.881 ug. The composite area wipe samples showed 4.431 ug.

Employees used Henkel BONDERITE S-ST 5351 AERO known as TURCO 5351 (T-5469) *MBO 330GLS to strip paint from parts. According to the SDS, Henkel BONDERITE S-ST 5351 AERO contains 30-60% methylene chloride.

A one gallon plastic water container, and several squirt bottles were use to store isopropyl alcohol on the bench outside the spray booth. b) On or about May 18, 2022, and at times prior, the employer did not ensure that flammable liquids were stored in containers that were in accordance with table H-12. A squirt bottle of isopropyl alcohol, which was not the original closed container or an approved safety can was stored inside the paint booth. An open-topped 5-galloon bucket of flammable liquid used to clean paint guns was stored inside the paint booth.

29 CFR 1910.107(b)(9): A clear space of not less than 3 feet on all sides was not kept free from storage or combustible construction: a) On or about May 18, 2022, and at times prior, the employer did not ensure that there was a clear space of not less than 3 feet on all sides of the spray booth, and the sides were kept free of storage. The spray booth was cluttered with items on the outside of the booth along both walls. On the wall to the right of the entrance, there was shelving with stacked cardboard boxes, and broken down cardboard boxes stacked against the wall of the spray booth. On the front side of the booth, 2 black carts were against the front wall of the booth.
