Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking/working surface 4 feet (1.2 m) or more above a lower level is protected from falling by one of the systems listed in 1910.28(b)(15)(i)-(iii): On or about 5/17/2022, adjacent to the offal load out area, employees mount the inside midrail of the mobile ladder's guardrail system as a means to elevate higher to check on the blood levels within the tankers.

29 CFR 1910.30(b)(1): The employer did not train each employee on or before May 17, 2017 in the proper care, inspection, storage, and use of equipment covered by this subpart before an employee uses the equipment: On or about 5/17/2022, adjacent to the offal load out area, employee's ascend a mobile ladder stand and mount the inside midrail of the ladder's guardrail system to check on the blood levels within the tankers, without being trained.
