29 CFR 1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. A.) On May 19, 2022, the employer did not instruct employees in the recognition and avoidance of hazards associated with trenching and excavating in that employees were working in an open trench that was measured to be in excess of 7' in depth without any type of cave in protection.

29 CFR 1926.651(j)(2):Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. A.) On May 18, 2022, employees were exposed to falling dirt and debris in that a spoils pile was not at least 2' from the edge of the unprotected trench or restrained by other means while employees were in the trench.

29 CFR 1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: -Excavations are made entirely in stable rock; or -Excavations are less than 5 feet (1.52m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. A.) On May 18, 2022, employees were exposed to cave in hazards in that they were working in an unprotected trench that was approximately 4' in width, 12' in length and 7' in depth without any type of cave in protection.
