OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards:  a)  At 600 West Interstate - 65 Service Road South (Northeast Building Area):  On or about May 17, 2022, the employees used a job-made platform being elevated by a JCB 507-42   Telescopic Handler (forklift) where other employees were standing, walking and working under the platform; thereby, exposing employees to struck-by hazards.

29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) At 600 West Interstate - 65 Service Road South (Northeast Building Area): On or about May 17, 2022,  the employer exposed employees to struck-by hazards in that hard hats or head protection was not provided to employees on the ground level while employees in an elevated job-made work platform above were performing window installation activities.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms without being specifically designed by the manufacturer for such use:  a) At 600 West Interstate - 65 Service Road South (Northeast Building Area):  On or about May 17,  2022, and times prior, the employer exposed employees to fall hazards up to thirty (30) feet to the concrete and ground below, in that employees were required to work from a job-made work platform that was not approved for use by the manufacturer and being elevated by a JCB 507-42   Telescopic Handler (forklift) while employees performed window installation activities.
