29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)  a) On May 19, 2022, MPZ Masonry Inc. did not ensure that a written respiratory protection program was established for employees required to wear respiratory protection, including 3M 8200 N95 respirators, when cutting brick to rebuild the west wall of Boiler #4.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)  a) On May 19, 2022, MPZ Masonry Inc. did not provide a medical evaluation to determine an employee's ability to wear a 3M 8200 N95 respirator before it was required to be used when rebuilding the west wall of Boiler #4.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR  1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: (Construction Reference 1926.103)  a) On May 19, 2022, MPZ Masonry Inc. did not ensure that an employee, required to use a 3M 8200 N95 respirator when rebuilding the west wall of Boiler #4, did not have facial hair that interfered with the seal between the facepiece and the face. 29 CFR  1910.134(k)(1)(i): The employer did not ensure that each employee could demonstrate knowledge of why the respirator was necessary and how improper fit, usage, or maintenance could compromise the protective effect of the respirator:  (Construction Reference 1926.103)  a) On May 19, 2022, MPZ Masonry Inc. required that its employee use a 3M 8200 N95 respirator without ensuring that they demonstrated knowledge why the respirator was necessary and how improper fit, usage, storage or maintenance can compromise the protective effect of the respirator.  An employee was observed wearing a respirator with both straps below the ears.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR  1926.1153(g)(1)(i): The exposure control plan did not contain a description of the tasks in the workplace that involve exposure to respirable crystalline silica:   a) On May 19, 2022, MPZ Masonry Inc. did not include in its Silica Exposure Control Plan an accurate description of all the tasks in the workplace that involved exposure to respirable crystalline silica. Exposure for this jobsite occurred when an employee was cutting brick with a stationary masonry saw while rebuilding the west wall of Boiler #4.  No abatement certification or documentation is required for this item.
