Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a. On or about May 17, 2022 at 221-01 69th Avenue, Oakland Gardens, NY 11364. Employees working on residential rooftop approximately 12 feet above the lower level installing roofing shingles were not protected from falling to the lower level. ABATEMENT CERTIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1926.503(a)(1):Employer did not provide fall protection training to those employees who might be exposed to a fall hazard. a. On or about May 17, 2022 at 221-01 69th Avenue, Oakland Gardens, NY 11364. Employees working on residential rooftop were not trained on the use of fall protection. The working level was approximately 12 feet from the lower level. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
