Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.   Location - 65 Weston Ln. 29 CFR  1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  Location - 65 Weston Ln. Hopkinton, Ma  On or about 5/13/2022, the employer did not ensure that employees were protected from potential falls to a lower level while utilizing self-made scaffolding (carpenter scaffolding). The employees erected the scaffold while not under the supervision of a competent person.

29 CFR  1926.501(b)(4)(i): Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.   Location - 65 Weston Ln. Hopkinton, Ma  On or about 5/13/2022, the employer did not ensure that employees were protected from falls to a lower level while conducting framing activities. The staircase opening leading to the basement was not guarded/covered to prevent falls to a lower level.

29 CFR  1926.1052(c)(7): When the top edge of a stairrail system also serves as a handrail, the height of the top edge shall be not more than 37 inches (94 cm) nor less than 36 inches (91.5 cm) from the upper surface of the stairrail system to the surface of the tread, in line with the face of the riser at the forward edge of the tread.  Location - 65 Weston Ln. Hopkinton, Ma  On or about 5/13/2022, the employer did not ensure that employees were protected from potential falls to a lower level while utilizing the stairway to access/egress to the second floor. The stairway did not have a handrail installed at the proper height.
