On or about May 17, 2022 at 85-02 Chelsea Street, Jamaica, NY, 11423.  An employee working on tubular welded frame scaffolds approximately 12 feet above the lower level conducting exterior façade work was not protected from falling to the lower level.  ABATEMENT CERTIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a.) On or about May 17, 2022 at 85-02 Chelsea Street, Jamaica, NY, 11423.  An employee working on tubular welded frame scaffold was not trained on the use of fall protection.  The working level was approximately 12 feet from the lower level.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19

29 CFR 1926.451(e)(1): Where scaffold platforms were more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers, stairway-type ladders, ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used for access:  a.) On or about May 17, 2022 at 85-02 Chelsea Street, Jamaica, NY, 11423.  An employee conducting exterior façade activities from a tubular welded frame scaffold did not have a means of access or egress to the scaffold.   The working level was approximately 12 feet from the lower level.  ABATEMENT CERTIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.
