29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a.) On or about May 17, 2022 at 85-02 Chelsea Street, Jamaica, NY, 11423.  An employee working on tubular welded frame scaffolds approximately 12 feet above the lower level conducting exterior façade work was not protected from falling to the lower level.  ABATEMENT CERTIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a.) On or about May 17, 2022 at 85-02 Chelsea Street, Jamaica, NY, 11423.  An employee working on tubular welded frame scaffold was not trained on the use of fall protection.  The working level was approximately 12 feet from the lower level.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19

An employee conducting exterior façade activities from a tubular welded frame scaffold that was not fully planked.  The working level was approximately 12 feet from the lower level.   ABATEMENT CERTIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.

On or about May 17, 2022 at 85-02 Chelsea Street, Jamaica, NY, 11423.  An employee conducting exterior façade activities from a tubular welded frame scaffold did not have a means of access or egress to the scaffold.   The working level was approximately 12 feet from the lower level.  ABATEMENT CERTIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.
