29 CFR  1910.106(e)(6)(ii):Grounding. Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with.  a) On or about May 12th, 2022, the employer did not ensure that in the bay area at building 4011, that a 5 gallon container of toluene (Category 2 flammable liquid) was bonded and grounded at the nozzle and nor was it interconnected to the containers that employees were transferring into, exposing employees to burn hazards.

29 CFR  1910.106(e)(2)(iv)(d): Flammable liquids shall be drawn from or transferred into vessels, containers, or portable tanks within a building only through a closed piping system, from safety cans, by means of a device drawing through the top, or from a container or portable tanks by gravity through an approved self-closing valve. Transferring by means of air pressure on the container or portable tanks shall be prohibited.  a) On or about 5/18/2022, employees working in the preparation and process area in building 4011 were exposed to burn hazards due to employees were drawing toluene (Category 2 flammable liquid) from an open glass container that was not a safety can and did not have a device drawing though the top, or by gravity through an approved self-closing valve.

29 CFR  1910.1200(h)(3)(iii): The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and,   a) On 5/18/2022, the employer did not train employees on the specific measures such as but not limited to ensuring flammable liquids are properly bonded and grounded to protect from hazardous chemicals such as but not limited to toluene (flammable).
