OSH ACT of 1970 Section (5)(a)(1): Respondent failed to furnish employees a place of employment free from recognized hazards that are causing or are likely to cause death or serious physical harm. (a) On or about May 19, 2022, an employee was conducting MIG welding repairs on the front end of an approximately 30- foot- long aluminum barge. The employer did not ensure that the area was free from hazards involved with a fuel tank in performing hot work welding operations related to boat repair.

29 CFR 1910.252(a)(2)(vi)(C): Cutting or welding was permitted in the presence of explosive atmospheres (mixture of flammable gases, vapors, liquids, or dusts with air), or explosive atmospheres that could develop inside uncleaned or improperly prepared tanks or equipment which had previously contained such materials, or that could develop in areas with an accumulation. (a) On or about May 19, 2022, employees were conducting MIG welding repairs on the front end of an approximately 30 foot long aluminum barge. The employer did not ensure all gasoline was drained from the internal gasoline tank and cleaned to ensure a flammable atmosphere could not develop, before performing welding operations. This exposed employees to an explosive atmosphere, and burn and struck-by hazards.

29 CFR 1910.252(a)(2)(vii): Where practicable, combustible materials were not relocated at least 35 feet (10.7 m) from the cutting or welding operation work site. (a) On or about May 19, 2022, employees were conducting MIG welding repairs on the front end of an approximately 30 foot long aluminum barge. The barge internal fuel tank was located within 30 feet of the MIG welding being performed on the front end of the barge. This exposed employees to an explosive atmosphere, and burn and struck-by hazards.
