29 CFR 1926.1203(a): Before work begins, the employer did not ensure that a competent person identifies all confined spaces in which one or more of the employees are to enter through consideration and evaluation of the elements of that space, including testing as necessary: a) Cayuga Health Project, 260 Tompkins Street, Cortland, NY 13045, on or about 5/11/22: The Superintendent entered a manhole to install a "test plug" for the purpose of checking drain systems in the main structure slab. The atmosphere was not tested prior to entry, there was no planning for retrieval, and no competent person for confined space was involved in the entry.
