On or about May 19, 2022, the employer required employees to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus and, despite having a Respiratory Protection Program than mandated fit testing in compliance with OSHA?s respiratory protection standard, the employer improperly fit tested one employee who had more than one day?s growth of facial hair prior to that employee?s initial use of the N95 filtering facepiece respirator.
