29 CFR  1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:   a) New residential construction located on Lot #13 at 2295 Church Street, Lovejoy, GA 30250, Roof: On or about 05/10/2022, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees operating these tools at 130 PSI engaged in framing and sheathing activities.   b) New residential construction located on Lot #13 at 2295 Church Street, Lovejoy, GA 30250, Second level top plate: On or about 05/10/2022, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees operating these tools at 130 PSI engaged in framing and sheathing activities.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) New residential construction located on Lot #13 at 2295 Church Street, Lovejoy, GA 30250, Roof: On or about 05/10/2022, the employer exposed employees to fall hazards of approximately 19-feet, 1-inch to the lower ground level, in that a fall protection system was not provided to employees engaged in sheathing activities on a 10/12 pitched roof.   b) New residential construction located on Lot #13 at 2295 Church Street, Lovejoy, GA 30250, Second level top plate: On or about 05/10/2022, the employer exposed an employee to fall hazards of approximately 19-feet, 6-inches to the lower level, in that a fall protection system was not provided while engaged in roof rafter installation using the top plate as a walking/working surface.

29 CFR  1926.1053(a)(2): Ladder rungs, cleats, and/or steps were not parallel, level, and uniformly spaced when the ladder was in position for use:   a) New residential construction located on Lot #13 at 2295 Church Street, Lovejoy, GA 30250, Stairwell located between first and second floor: On or about 05/10/2022, the employer exposed employees to fall hazards of up to 12-feet, in that the job-made ladder used to access the upper level had cleats which were not uniformly spaced which created a fall hazard while accessing each level. Spaces between each cleat (2x4 rung) ranged from 12-inches to 21-inches.

29 CFR  1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.      a) New residential construction located on Lot #13 at 2295 Church Street, Lovejoy, GA 30250, Stairwell located between first and second floor: On or about 05/10/2022, the employer exposed employees to fall hazards of up to 12-feet, in that the job-made ladder used to access the upper level did not reach the second level and the side rails did not extend at least 3-feet past the landing to allow for safe access to all levels.
