On or before May 24, 2022, at a worksite located at 267 South 30th Street, Newark, Ohio 43056, the employer did not develop and provide an excavation safety program to ensure employees working in and around excavations had knowledge of the safety and health regulations and the ability to identify and correct unsafe conditions onsite.

29 CFR 1926.651(c)(2):Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a. On or before May 24, 2022, at a worksite located at 267 South 30th Street, Newark, Ohio 43056, the employer failed to ensure a safe means of egress were located within 25 feet of where employees were working. Employees were working in an excavation that was 62 feet in length with one ladder used for egress in the corner of the excavation requiring employees to traverse up to 62 feet to reach the egress point.

29 CFR 1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. a. On or before May 24, 2022, at a worksite located at 267 South 30th Street, Newark, Ohio 43056, employees were exposed to a cave-in hazard while performing work in an approximately 6-foot 2-inch excavation. The employer did not ensure that the sloping and benching system used was complaint with the 1926.652(b)(1)-(b)(4) requirements.
