29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a)Red Dog Construction, Inc. near intersection of Iowa Avenue and Washington Street in Hurley, SD 57036: On or about and at times prior to May 19, 2022, the employer did not ensure employees bracing roof trusses on a pole barn were protected from fall hazards by use of an adequate fall protection system. Two employee did not utilize any fall protection system when standing on the exterior top plate and climbing through roof trusses, exposed to an approximate 16 foot fall hazard to a soil lower level.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  (a)Red Dog Construction, Inc. near intersection of Iowa Avenue and Washington Street in Hurley, SD 57036: On or about and at times prior to May 19, 2022, the employer did not ensure employees operating a Sky Jack SJ7127 Scissor Lift were protected by guardrails or other fall protection systems when elevated above 10 feet. This condition exposed employees to approximate 12 foot fall hazards.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  (a)Red Dog Construction, Inc. near intersection of Iowa Avenue and Washington Street in Hurley, SD 57036: On or about and at times prior to May 19, 2022, the employer did not ensure employees operating the JLG Lift 400 Aerial Lift wore appropriate fall restraint or fall protection. This condition exposed employees to fall hazards of approximately 12 feet.   Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. (a)Red Dog Construction, Inc. near intersection of Iowa Avenue and Washington Street in Hurley, SD 57036: On or about and at times prior to May 19, 2022, the employer did not ensure employees were protected from eye hazards from operating a pneumatic nail gun by use of appropriate eye protection. This condition exposed employees to eye hazards.
