OSH ACT of 1970 Section (5)(a)(1): 29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicles while working in a roadway. Location - 152 Eliot Street, Ashland, MA. On or about May 25, 2022, two employees performing tree removal from a residential property and laying the tree sections onto a road. The employees working/walking in the temporary traffic control zone on an active road were not wearing high visibility class 2 minimum or class 3 apparel for equipment (skid steer) and or vehicles/traffic.

29 CFR 1910.180(d)(4): "Periodic inspection." Complete inspections of the crane shall be performed at intervals as generally defined in paragraph (d)(2)(ii) of this section depending upon its activity, severity of service, and environment, or as specifically indicated below. These inspections shall include the requirements of paragraph (d)(3) of this section and in addition, items such as the following. Any deficiencies such as listed shall be carefully examined and determination made as to whether they constitute a safety hazard. Location - 152 Eliot Street, Ashland, MA. On or about May 25, 2022, an employee was using a crane at a residential work site to hoist large sections of cut trees from the rear of the residents property over the house and then lowering them onto a public road. The cranes annual inspection was expired.
