OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm including severe burns, to employees in that employees were exposed to a dust explosion, deflagration, or other fire hazards from combustible dust. a) Pellet mill operation, located at 1377 Old Nunez Rd., Swainsboro, GA 30401: On or about May 22, 2022, and times prior to, the employer exposed employees to a dust explosion, deflagration, or other fire hazards from combustible dust, in that the employer did not perform a Dust Hazard Analysis of the operation. FEASIBLE ABATEMENT METHOD: Have a Dust Hazard Analysis performed at the facility according to NFPA 652, Standard on the Fundamentals of Combustible Dusts, 2019 Edition, Chapter 7 Section 7.1.2 which states, "The owner/operator of a facility where materials determined to be combustible or explosible in accordance with Chapter 5 are present in an enclosure shall be responsible to ensure a DHA is completed in accordance with the requirements of this chapter."
