29 CFR 1910.212(a)(3)(ii):The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. The employer does not protect the point of operation of Biro band saw machines whose operation exposes employees to amputation hazards. This most recently occurred on and preceding, May 21, 2022, and at times thereafter, at Fiesta Mart Store #59, 1200 E. Parker Rd. Plano, TX 75074 where employees are exposed to amputations hazards when cutting various types of meats on the unguarded Biro band saw Model #3334, Serial #49597 in the meat cutting department.
