29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial trucks were performed by the employer without the manufacturer's prior written approval: (a)Midwest Railcar Repair, Inc., at 25965 482nd Avenue, Brandon, SD 57005: On or about and at times prior to May 25, 2022 , the employer did not ensure that lifting fixtures that were manufactured in house and used as fork extensions were rated for the loads they were intended to carry and approved by the manufacturer of the Powered Industrial Truck (PIT) that they were installed on. Multiple unrated, unmarked lifting fixtures were identified throughout the facility. This condition exposed employees to serious crushed-by and struck-by hazards.

29 CFR 1910.178(o)(2): Loads were being handled which exceeded the rated capacity of the industrial trucks: (a)Midwest Railcar Repair, Inc., at 25965 482nd Avenue, Brandon, SD 57005: On or about and at times prior to May 25, 2022 , the employer did not ensure employees used Powered Industrial Trucks (PIT) with a designated capacity capable of lifting the intended loads. Employees used forklifts with a designated weight capacity of 3650 lbs. with a local manufactured extension to lift, among other items, 4000 pound truck sets from under rail cars. This condition exposed employees to struck-by and crushing hazards.

One employee was observed having spray foam shavings blown off his person by a second employee outside the south door of the the mechanical building. This condition exposed an employee to embolisms, eye and skin injuries from flying debris and other air pressure injuries.
