Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards: a) Baker Industrial Fabrication, LLC, 5660 Iris Pkwy, Frederick, CO 80504: On or about 5/24/2022, the employer did not ensure its employees were protected from the hazards of a compressed gas cylinder tipping over and becoming a projectile in the "Full" cage, located on the east side of the yard. The cylinders were not secured. Workers were exposed to struck-by hazards.

29 CFR 1910.184(c)(12): Sling(s) were pulled from under load(s) when load(s) were resting on the sling(s): (a) Baker Industrial Fabrication, LLC, 5660 Iris Pkwy, Frederick, CO 80504: On or about 5/24/2022, the employer did not ensure that employees were clear of a load that was just staged for paint, prior to the powered industrial truck lifting the sling from the load. The sling caught a piece of the material as it was being lifted, causing the material to roll. This exposed employees to struck by hazards.

29 CFR 1910.303(g)(1)(i)(C): For electric equipment operating at 600 volts, nominal, or less to ground, and likely to require examination, adjustment, servicing, or maintenance while energized, the width of work space was not clear and did not extend from the grade, floor, or platform to the height required by paragraph (g)(1)(vi) of 29 CFR 1910.303: a) Baker Industrial Fabrication, LLC, 5660 Iris Pkwy, Frederick, CO 80504: On or about 5/24/2022, the employer did not ensure that the space about the electrical cabinet on the south-east side of the shop was not clear of obstruction to the floor. There were multiple welding leads laying on the floor, just in front of and below the electrical cabinet. This exposed workers to electrical and fire hazards.
