The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a) On or about May 11, 2022, the employer did not ensure that his employees were trained to operate a powered industrial trucks such as Vermeer S800TX Mini Skid Steer after forks had been added and used at residential jobsites.

Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On or about May 11, 2022, there was no frequent and regular inspection program being maintained in use by a competent person to ensure the job site, material and equipment; such as but not limited to recognize the texture of the ground in which work was being conducted and/or the weight being carried by the mini skid steer that had been converted to a forklift.
