1926.20(b)(2)  Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):  a) On or about 5/24/2022 at a water line project located at Elmwood Avenue and Mt. Hope Avenue, Rochester, New York; an employee was in an excavation to make final connections of a wire. The excavation was approximately 6'-5" feet deep south of the water line and 6'2" deep north of the water line. There were vertical walls on the ends and incomplete slope/shelf on the sides.  NO ABATEMENT CERTIFICATION REQUIRED
