29 CFR 1910.1200(e)(1):Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a) AED Group HC, LLC dba Donato's, on or about May 26th, 2022 and times prior thereto: Employees worked with and around hazardous substances including but not limited to, Peroxide Multi Surface Cleaner and Disinfectant, Heavy duty degreaser, and Freezer/Cooler cleaner during cleaning operations. A worksite specific hazard communication program had not been developed and implemented. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) AED Group HC, LLC dba Donato's, on or about May 26th, 2022 and times prior thereto: Employees worked with and around hazardous substances including but not limited to, Peroxide Multi Surface Cleaner and Disinfectant, Heavy duty degreaser, and Freezer/Cooler cleaner during cleaning operations. The employer did not provide hazard communication training for all employees who worked with and around hazardous substances. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).
