29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) Jobsite: On or about May 31, 2022, employees were working within 15 feet of the edge of the roof as they were working to install solar panels on a flat roof and they were not protected from falling about 27 feet to asphalt/concrete. In addition, there were no warning lines on the roof.

29 CFR 1926.503(c):The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: (a) Jobsite: On or about May 31, 2022, employees need to be retrained on when to use fall protection when working on a roof. Employees were working within 15 feet of the edge of a roof and were not protected from falling to the ground. The fall hazard was about 27 feet to the asphalt/concrete parking area.
