29 CFR  1910.146(c)(1):  The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces:  Pool:  On, our about, May 31, 2022, the employer had not evaluated the inground pool to determine if the annual painting operation created a permit required confined space while employees were applying Paralon 2 paint/coating to pool surface.  Paralon 2 was classified as a Category 3 flammable liquid, affected the central nervous system and contained a suspect carcinogen.

29 CFR  1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical:  Maintenance Department:  On, or about, May 31, 2022, the employer did not have copies of the Safety Data Sheets for hazardous chemicals such as, but not limited to, Paralon paint, a category 3 flammable liquid with a flashpoint of 110 degrees, F that also had health hazard warnings associated with the central nervous system that contained a possible carcinogen and for Phoenix liquid chlorine shock, a corrosive liquid with a pH of 12.  Abatement Note:  An inventory of hazardous chemicals will need to be made and additional safety data sheets will need to be obtained for other hazardous chemicals used including fuels, herbicides, automotive fluids, etc...
