29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:  On or about May 31, 2022, at an establishment located at N6581 Villa Parkway in Westfield, Wisconsin; the employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE) such as, but not limited to, respiratory protection. Employees were exposed to SARS-CoV-2 (severe acute respiratory syndrome coronavirus-2), the virus that causes COVID-19, while caring for suspected or confirmed COVID-19 positive patients.

29 CFR 1910.134(a)(2): A respirator shall be provided to each employee when such equipment is necessary to protect the health of such employee. The employer shall provide the respirators which are applicable and suitable for the purpose intended. The employer shall be responsible for the establishment and maintenance of a respiratory protection program, which shall include the requirements outlined in paragraph (c) of this section. The program shall cover each employee required by this section to use a respirator.  On or about May 31, 2022, at an establishment located at N6581 Villa Parkway in Westfield, Wisconsin; the employer did not provide each employee a respirator when such equipment was necessary to protect the health of the employees. The employer did not provide a suitable respirator to employees performing aerosol-generating procedures and/or close contact resident care for suspected or confirmed positive COVID-19 residents.

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable.  On or about May 31, 2022, at an establishment located at N6581 Villa Parkway in Westfield, Wisconsin;  the employer did not establish and implement a written respiratory protection program when employees were exposed to SARS-CoV-2, the virus that causes COVID-19, while working with confirmed positive residents.   All provisions of 29 CFR 1910.134(c) through (m) must be contained in a written respiratory protection program. Key provision include, but are not limited to the following:  1) Medical evaluations for respirator use  2) Fit testing  3) Information/training on maintenance, use, and care  4) Respirator selection  5) Recordkeeping
