29 CFR 1910.106(d)(2)(i): Only approved containers and portable tanks shall be used. Metal containers and portable tanks meeting the requirements of and containing products authorized by chapter I, title 49 of the Code of Federal Regulations (regulations issued by the Hazardous Materials Regulations Board, Department of Transportation), shall be deemed to be acceptable. At a facility located at 1425 State Street, Green Bay, WI 54304; containers of diesel fuel that had been syphoned from truck fuel tanks were not approved metal containers authorized by chapter 1, title 49 of the Code of Federal Regulations.

29 CFR 1910.1200(f)(6)(ii): The employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical: At a facility located at 1425 State Street, Green Bay, WI 54304; the employer did not ensure that containers of diesel fuel syphoned from truck fuel tanks were labeled, tagged or marked with the product identifier and words, pictures, symbols, or a combination thereof, which provided information regarding the hazards of the chemical.
