29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: (a) BriMark Builders, LLC at 1215 N Main St. Lamar, CO 81052: On or before 6/1/22 the controlling and correcting employer did not protect subcontractor employees from injury in that subcontractor employees rode and worked from a job-made wooden pallet that was not designed by a qualified person. The pallet was approximately 12x12 feet while the forklift tines were 4 feet long. The pallet lacked guard rails. The pallet was not secured to the mast or to the forks of the forklift. These conditions exposed subcontractor employees to fall hazards up to 30 feet. Abatement Note: Abatement Certification and Documentation are required for this item. 29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: (a) BriMark Builders, LLC at 1215 N Main St. Lamar, CO 81052: On or before 6/1/22 the controlling and correcting employer did not protect subcontractor employees from injury in that subcontractor employees rode a job-made wooden pallet up and down to access the roof of a 3 story hotel. Fall protection and or guard rails were not used when riding the pallet or working from it. Subcontractor employees were not wearing fall protection and the pallet lacked guard rails and other methods to safeguard the employees. The pallet was not secured to the mast or to the forks of the forklift. These conditions exposed subcontractor employees to fall hazards up to 30 feet. 29 CFR 1926.602(c)(1)(viii): A lift truck, equipped with vertical only, or vertical and horizontal controls elevatable with the lifting carriage or forks for lifting personnel, did not have the following precautions to include (A) Use of a safety platform firmly secured to the lifting carriage and/or forks (B) Means whereby personnel on the platform can shut off power to the truck (C) Protection from falling objects as indicated necessary by the operating conditions: (a) BriMark Builders, LLC at 1215 N Main St. Lamar, CO 81052: On or before 6/1/22 the controlling and correcting employer did not protect subcontractor employees from injury in that subcontractor employees rode a job-made wooden pallet up and down to access the roof of a 3 story hotel. Subcontractor employees were not wearing fall protection and the pallet lacked guard rails and other methods to safeguard the employees. The pallet was not secured to the mast or to the forks of the forklift. The mast did not have controls to be operated by the employees on the pallet. This forklift was not designed to be used as a man lift. The pallet also lacked protection from falling objects. These conditions exposed subcontractor employees to fall hazards up to 30 feet.
