The pallet was approximately 12x12 feet while the forklift tines were 4 feet long. The pallet was not secured to the forklift. These conditions exposed employees to fall hazards up to 30 feet. 29 CFR 1926.602(c)(1)(viii): A lift truck, equipped with vertical only, or vertical and horizontal controls elevatable with the lifting carriage or forks for lifting personnel, did not have the following precautions to include (A) Use of a safety platform firmly secured to the lifting carriage and/or forks (B) Means whereby personnel on the platform can shut off power to the truck (C) Protection from falling objects as indicated necessary by the operating conditions: (a) J&B Construction at 1215 N Main St. Lamar, CO 81052: On or before 6/1/22 the creating, correcting, and exposing employer did not protect employees from injury in that employees rode a job-made wooden pallet up and down to access the roof of a 3 story hotel. Employees were not wearing fall protection and the pallet lacked guard rails and other methods to safeguard the employees. The pallet was not secured to the mast or to the forks of the forklift. The mast did not have controls to be operated by the employees on the pallet. This forklift was not designed to be used as a man lift. The pallet also lacked employee protection from falling objects. These conditions exposed employees to fall hazards up to 30 feet. Abatement Note: Abatement Certification and Documentation are required for this item.
