29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about May 31, 2022, and at times prior, the employer did not ensure that safety and health programs were initiated and maintained to protect employees during residential roofing work activities, thereby exposing employees to fall and struck-by hazards. These programs included, but were not limited to, fall protection/prevention, ladder safety, and personal protective equipment.

29 CFR  1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. On or about May 31, 2022, and at times prior, the employer failed to instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize hazards associated with residential roofing work. Employees were not trained on subjects such as, but not limited to, fall prevention/protection, ladder safety, and personal protective equipment.

Located at 9106 Palomino Drive, Pickerington, Ohio 43147: On or about May 31, 2022, the employer did not ensure that employees utilized eye protection while utilizing pneumatic nail guns and saws to perform a roof tear-off and re-roof job, thereby exposing employees to struck-by hazards.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. Located at 9106 Palomino Drive, Pickerington, Ohio 43147: On or about May 31, 2022, the employer did not ensure that employees were protected from fall hazards while performing roofing work from the second story roof of a pre-existing residential structure, thereby exposing subcontractor employees to fall hazards of up to approximately 23 feet.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. Located at 9106 Palomino Drive, Pickerington, Ohio 43147: On or about May 31, 2022, the employer did not ensure that multiple Werner extension ladders in use to access the roof of the existing house were extended at least three feet above the upper landing surface of the roof, thereby exposing employees to fall hazards of approximately 19 feet.
