29 CFR 1910.29(b)(2): The employer did not ensure that guardrail systems met the requirement that midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent intermediate members were installed between the walking-working surface and the top edge of the guardrail system when there was not a wall or parapet that was at least 21 inches (53 cm) high: Employees engaged in waste water treatment activities at the Blue River Coatings facility located at 2910 South Nebraska Avenue, Hastings, Nebraska, were exposed to fall hazards in that there was nothing protecting employees between the platform surface and the top rail. The platform surface was more than 4 feet above the ground.

29 CFR 1910.25(b)(7): The employer did not ensure that standard stairs were used to provide access from one walking-working surface to another when operations necessitated regular and routine travel between levels, including access to operating platforms for equipment. Winding stairways may be used on tanks and similar round structures when the diameter of the tank or structure is at least 5 feet (1.5 m): Employees engaged in waste water treatment activities at the Blue River Coatings facility located at 2910 South Nebraska Avenue, Hastings, Nebraska, were exposed to slip hazards in that a fixed ladder was used to access the upper-level platform for regular waste water treatment activities.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: Employees engaged in paint mixing activities at the color bay of Blue River Coatings located at 2910 South Nebraska Avenue, Hastings, Nebraska, were exposed to hazards associated with insufficient point of operation machine guarding in that drill presses used for mixing paint products did not have guarding around the rotating chuck. These drill presses included but were not limited to Grizzly G7947 17-inch floor drill press.
