29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace: In the facility at 169 Valentine Rd Pittsfield MA 01201: On or about June 07, 2022, employees required to use N95 respirators during tasks, such as, but not limited to, the provision of medication, treatment, and other care as necessary to residents confirmed positive for COVID-19, were not medically evaluated for their ability to use a respirator. The following instances were found to be in violation of the standard: a) At the facility on or about June 7, 2022, at least two (2) employee were not medically evaluated prior to been required to wear an N95 respirator to provide care to COVID positive residents in Unit 5. b) At the facility, on or about June 7, 2022, at least two (2) employees were medically evaluated 26 and 95 days after been fit tested on Makrite Sekura N95 respirators and been required to provide care to COVID positive residents in Unit 3 and Unit 5. Hillcrest Commons Extended Care was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.134(e)(1), which was contained in OSHA Inspection number 1507145, citation number 1 item number 1-b and was affirmed as a final order on May 26, 2021, with respect to a workplace located at 169 Valentine Rd Pittsfield MA 01201.

29 CFR 1910.134(f)(2):The employer did not ensure that employees using a tight-fitting respirator were fit tested prior to initial use of the respirator, whenever a different respirator facepiece was used, and at least annually thereafter: At the Facility at 169 Valentine Rd Pittsfield, MA 01201: On and about June 07, 2022, the employer did not provide a fit test to employees required to wear a respirator, prior to initial use of the respirator, when a different respirator was used and at least annually thereafter. Employees were required to wear N95 filtering-facepiece respirators to protect against SARS-CoV-2 virus while providing care, such care as feeding, washing, dressing, and other personal care, to suspected and confirmed COVID-19 positive residents. a) On and before June 07, 2022, at least three (3) employees included in the Respiratory Protection Program were fit tested initially however they were not fit tested annually thereafter. These three (3) employees were COVID positive after been exposed to COVID positive patients. b) On and before June 07, 2022, at least one (1) employee was included in the Respiratory Protection Program and was not fit tested initially. This employee was COVID positive after been exposed to COVID positive patients. Hillcrest Commons Extended Care. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.134(f)(2), which was contained in OSHA Inspection number 1507145, citation number 1, item number 1c, and was affirmed as a final order on May 26, 2021, with respect to a workplace located at 169 Valentine Rd Pittsfield, MA 01201
