Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and amputation hazard. On or about June 7, 2022 at Vitex Extrusions, Franklin, NH. Employees were exposed to a struck by and, or amputation hazard when the extrusion became caught in the die and under a sudden release of pressure the extrusion acted as a projectile.

The walking working surface was not free from protruding objects, in that metal beams were protruding approximately 6.5 inches to 8.5 inches from the surface of the floor.

29 CFR 1910.151(c):Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use. On or about June 14, 2022 at Vitex Extrusions, Franklin, NH. Multiple eyewash stations were not available for immediate emergency use. Instance 1. The eyewash station had metal beams approximately 6.5 inches to 8.5 inches in height on secured to the floor, along two adjoining sides creating a tripping hazard, preventing immediate use of the eyewash station. Instance 2. The eye wash station was block from immediate use by a pallet of materials being stored underneath it.
