OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by, caught-between, amputation, and fall hazards from defective personnel lift platforms (i.e. work platform) that were utilized on powered industrial trucks to lift personnel: A.) MT Savage Specialty Refractories Company, on or about 6/8/22 the XYZ personnel lift platform was utilized on powered industrial trucks including but not limited to the Toyota 8FBCU25 to lift personnel when maintenance activities were required in elevated areas of the facility. The personnel lift platform was defective in that: 1.) Railings and decking were bent, damaged, and deformed. 2.) Mid-rail devices were not used at the platform's entranceway and was only outfitted with a single chain which acted as a sagging top rail 3.) Only one chain was utilized to secure the platform to the forklift. 4.) The hook used to secure the platform was too large to fit through the chain and as a result the chain to not rest in the base (bowl/saddle) of the hook. 5.) The hook for the securement chain was not equipped with a safety latch 6.) The platform was not outfitted with a device to prevent personnel in the platform from becoming entangled in the power industrial trucks lifting mechanisms. NO ABATEMENT CERTIFICATION OR DOCUMENATION REQUIRED

29 CFR 1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly: a.) Mt. Savage Specialty Refractories Company, on or about 6/8/22 and times prior thereto, in the manufacturing area a lifting attachment was being used with a variety of different fork trucks onsite. The attachment was used for work operations including, but not limited to, lifting employees to change lights in the facility. The company had not received permission from the forklift manufacture's approval to use the attachment. NO ABATEMENT CERTIFICATION OR DOCUMENATION REQUIRED
