OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards.  A.)  Tire Xpress Inc., 533 Taylor Street, New Castle, PA  16101, on or about June 7, 2022 and times prior thereto:  employees were potentially exposed to struck-by hazards while working under and/or near potentially defective automotive lifts due to the lack of an automotive lift inspection program.  Procedures were not established to conduct daily and routine inspections the automotive lifts in order to identify defects associated with the working operation of the lifts.  Annual and routine inspections of components such as, but not limited to, the structural components, electrical components and wiring, lift controls, including operation of the positive stop, and the lift locks for the automotive lifts were not conducted.

29 CFR 1910.101(b):The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-, which is incorporated by reference as specified in CFR 1910.6; 5.8.4 Cylinder positions in storage: All compressed gas cylinders in service or in storage at user locations shall be secured to prevent falling or rolling:  A.) Tire Xpress Inc., back warehouse south wall, on or about June 7th, 2022 and time prior thereto; One oxygen cylinder was stored in the back warehouse along the south wall was free standing and not properly secured to prevent the cylinder from tipping and/or being knocked over.  B.) Tire Xpress Inc., back warehouse south wall, on or about June 7th, 2022 and time prior thereto; One acetelyne cylinder was stored in the back warehouse along the south wall was free standing and not properly secured to prevent the cylinder from tipping and/or being knocked over.

Vegetation control will be exercised when necessary.  a.) Tire Xpress Inc., Back warehouse area, on or about June 7th, 2022 and times prior thereto:  Employees walking/working in the storage area of the back warehouse were exposed to trip hazards.  The isleway between storage rack had been partially blocked due to tires stacked on the floor in the area.
