29 CFR  1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) On or about June 8, 2022,  the employer did not maintain a written respiratory protection program when they required employees to use tight fitting and N95 respirators. This condition exposed employees to respiratory hazards.

29 CFR  1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) On or about June 8, 2022, the employer did not ensure that all employees who were required to wear tight-fitting respirators while conducting normal job operations were medically evaluated prior to use of the respirator.   Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.

29 CFR  1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:   (a) On or about June 8, 2022, the employer did not ensure that employees using a tight-fitting facepiece respirator (N95) were fit tested prior to initial use.  Employees were issued and required to utilize N95 respirators due to COVID-19 Community Spread Levels, and while providing care to residents exhibiting symptoms of COVID-19, without fit testing prior to initial use.  This condition exposed employees to respiratory hazards and health hazards associated with COVID-19.
