29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Ernesto MTZ Construction LLC. located at 1550 Kenny Road, Grandview Heights, OH 43212: On and preceding June 10, 2022, the employer did not ensure that employees were protected from falls while working on an open sided balcony. A masonry crew was working on an open sided balcony on a multi-story building at heights up to 38 feet. The balcony did not have guardrails or any other means of fall protection in place thereby exposing employees to falls up to 38 feet.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) Ernesto MTZ Construction LLC. located at 1550 Kenny Road, Grandview Heights, OH 43212: On and preceding June 10, 2022, the employer did not ensure that employees were protected from falls while working from a supported scaffold. A scaffolding platform used for masonry work on a multi-story building had sections throughout the top tier of the platform near the areas work was being performed that did not have guardrails or other means of fall protection in place thereby exposing employees working on scaffolding to falls up to 38 feet. Ernesto MTZ Construction LLC. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.451(g)(1) which was contained in OSHA inspection number 1431844, citation number 1, item number 2 and was affirmed as a final order on January 31, 2020, with respect to a workplace located at 1 Main Street, TOLEDO, OH 43605.
