29 CFR 1926.501(b)(1): Fall Protection. Duty to have fall protection. "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about June 03, 2022, the employer did not ensure that the employees exposed to a 16' 6" fall hazard were utilizing any conventional fall protection while performing roofing work on a commercial roof top.

29 CFR 1926.503(a)(1): The following provisions supplement and clarify the requirements of 1926.21 regarding the hazards addressed in Subpart M of this part. Training program. The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a) On or about June 03, 2022, the employer did not ensure fall protection training was provided to the employees that worked on top of the roof, none of the employees had receive training on fall protection systems and on hazards of falls, while working on heights of 16.6 ft. from the ground.
