29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) a- 17 Senator's Way, Atco NJ: Workers engaged in shingle installation and other roofing related activities were exposed to fall hazards, up to and in excess of 9 feet 4 inches to the ground surface below, when walking on and working from a residential structure's pitched porch roof without the use of fall protection. These workers had not received fall protection training from a competent person qualified in the areas specified in 29 CFR 1826.503(a)(2)(i) through (viii). Condition noted on or about 06/13/22. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a- 17 Senator's Way, Atco NJ: Workers engaged in shingle installation and other roofing related activities were exposed to fall hazards, up to and in excess of 9 feet 4 inches to the ground surface below, when walking on and working from a residential structure's pitched porch roof without the use of fall protection. Condition noted on or about 06/13/22. Jorge Riano Construction, LLC. cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1386536, citation number 1, item number 1 and was affirmed as a final order on 06/6/19, with respect to a workplace located at Residential Property at 211 Woodlane Avenue, Haddonfield NJ.
