29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushed-by and struck-by hazards: a. At the facility located at 6407 Blanding Boulevard in Jacksonville, Florida 32244: On or about June 13, 2022, employees performing powered industrial truck (forklift) operations were exposed to crushed-by and struck-by type hazards, while operating a Nissan-brand forklift that did not have an installed seat belt, or other means of restraint, to ensure the employees remain safely inside the operator's compartment in the event of a sudden, unexpected motion. The employer did not ensure that a forklift operator restraint device or seat belt was installed and used.
