29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)Andrade Roofing at 5710 East Hitching Place, Sioux Falls, SD 57103:  On or about and at times prior to May 31, 2022, the exposing employer did not ensure that an employee was protected from falls while conducting roofing operations on a residential property.  This condition exposed the employee to fall hazards greater than six feet.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a)Andrade Roofing at 5710 East Hitching Place, Sioux Falls, SD 57103:  On or about and at times prior to May 31, 2022, the exposing employer did not ensure that employees were properly trained on the use of fall protection systems prior to being exposed to fall hazards while working on a low-slope residential roof.  This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)Andrade Roofing at 5710 East Hitching Place, Sioux Falls, SD 57103:  On or about and at times prior to May 31, 2022, the exposing employer did not ensure that the ladders being used for access to the second story work surface and the roof of the low-slope residential property were extended at least three feet above the upper landing surface.  This condition exposed employees to fall hazards associated with ladder access greater than six feet.
