29 CFR  1904.29(b)(3): The employer did not enter each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred.  On or about June 14, 2022, the Rustic Gem, LLC facility located at 11043 Durkee Road in Grafton, Ohio did not record an employee's fingers being lacerated and later resulted in one of those fingers being amputated, within 7 days after first learning that the employee was injured as a result of a work-related incident. Instead, the employer recorded the incident on June 11, 2022 approximately 19 days after first learning about the laceration incident.

29 CFR  1904.39(a)(2): The employer did not report within twenty-four (24) hours after the employer leaned about the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident to OSHA.  On or about June 14, 2022, the Rustic Gem, LLC facility located at 11043 Durkee Road in Grafton, Ohio did not report an employee's finger being amputated within 24 hours after first learning that the employee was injured as a result of a work-related incident which later required the employee's finger be amputated. Instead, the employer reported the hospitalization approximately 16 days after first learning about the amputation.

29 CFR  1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  On or about June 14, 2022, the employer at the Rustic Gem, LLC facility located at 11043 Durkee Road in Grafton, Ohio did not create nor certify a written PPE hazard assessment for the mowing operations of using the mowers to cut the grass of the golf course including using the Toro Reelmaster 3100-D mower.
