29 CFR  1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) On or before June 14, 2022 the exposing employer did not ensure that employees were protected from injury, in that one employee repairing a sign located on the north side of Parry's Pizza, which is located on the second story along the north outer wall of the building, was working on the roof top of the outer refrigerator and was not utilizing a fall protection system.  The employee had fall harnesses and equipment available; however, they were not used and were left in the boom truck on site.  This condition exposed the employee to a fall of approximately 10 to 13 feet onto the concrete sidewalk below.  (b) On or before June 14, 2022 the exposing employer did not ensure that employees were protected from injury, in that one employee repairing a sign located on the north side of Parry's Pizza, which is located on the second story along the north outer wall of the building, was working on the roof top of the outer refrigerator and used a Werner 12-foot "A frame" ladder to gain access to the rooftop of the first story refrigerator roof at a height of approximately 11 feet by leaning the ladder against the side of the building and climbing it in a manner not intended for the safe use of this type of ladder.  The ladder was improperly used for this application, not secured and was not the proper height to safely mount the roof.

29 CFR  1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed:  (a) On or before June 14, 2022 the exposing employer did not ensure that employees were protected from injury, in that one employee repairing a sign located on the north side of Parry's Pizza, which is located on the second story along the north outer wall of the building, was working on the roof top of the outer refrigerator and was not utilizing a fall protection system.  The employee had fall harnesses and equipment available; however, they were not used and were left in the boom truck on site. 29 CFR  1926.1060(b): The employer did not provide retraining as necessary so that each employee exposed to fall hazards maintained the understanding and knowledge acquired through initial training:   (a) On or before June 14, 2022 the exposing employer did not ensure that employees were protected from injury, in that one employee repairing a sign located on the north side of Parry's Pizza, which is located on the second story along the north outer wall of the building, was working on the roof top of the outer refrigerator and was not utilizing a fall protection system.
