29 CFR  1910.146(c)(1): The employer shall evaluate the workplace to determine if any spaces are permit-required confined spaces.  On or about June 14, 2022, at the facility located at 450 West 33rd Avenue, Oshkosh, WI 54903, the employer did not properly evaluate the workplace to determine if any spaces are permit-required confined space, exposing employees to the hazards associated with permit-required confined space hazards, such as but not limited to chemical, electrical, hazardous atmosphere (natural gas), mechanical, pneumatic, and thermal, in the following instances:  a) Flow 1 was not determined to be a permit-required confined space. b) Flow 2 was not determined to be a permit-required confined space. c) Flow 3 was not determined to be a permit-required confined space.  Note: Proper application of the decision flow chart in appendix A to � 1910.146 would facilitate compliance with this requirement.

29 CFR  1910.146(c)(2): If the workplace contains permit spaces, the employer shall inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces. NOTE: A sign reading DANGER -- PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.  On or about June 14, 2022, at the facility located at 450 West 33rd Avenue, Oshkosh, WI 54903, the employer did not ensure that exposed employees were informed by posting danger signs or by any other equally effective means, of the existence and location of the danger posed by permit-required confined spaces, exposing employees to the hazards associated with permit required confined spaces, such as but not limited to chemical, electrical, hazardous atmosphere (natural gas), mechanical, pneumatic, and thermal, in the following instances:  a) Entrances into Flow 1  were not posted as a permit-required confined space. b) Entrances into Flow 2  were not posted as a permit-required confined space. c) Entrances into Flow 3  were not posted as a permit-required confined space.

29 CFR  1910.146(c)(4): If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with 29 CFR 1910.146. The written program shall be available for inspection by employees and their authorized representatives.   At the facility located at 450 West 33rd Avenue, Oshkosh, WI 54903, the employer did not develop and implement a written permit-required confined space program that complied with 29 CFR 1910.146, exposing employees to the hazards associated with permit-required confined spaces, such as but not limited to chemical, electrical, hazardous atmosphere (natural gas), mechanical, pneumatic, and thermal in the following instances:  a) On or about May 31, 2022, an employee was required to enter Flow 1, a permit-required confined space, to perform cleaning. b) On or about June 29, 2022, an employee was required to enter Flow 2, a permit-required confined space, to perform cleaning.  All provisions of 29 CFR 1910.146(d) shall be contained in a written permit-required confined space program. Key elements include, but are not limited to the following: a. Procedures for measures necessary to prevent unauthorized entry; b. Procedures to identify and evaluate the hazards of permit spaces. c. Procedures necessary for safe permit space entry operations (acceptable conditions for entry, providing entrants with the opportunity to test permit spaces, ventilating the permit space as necessary to eliminate or control atmospheric hazards and verifying that conditions are acceptable for entry throughout the duration of entry). d. Procedures for providing testing and monitoring equipment, ventilating equipment, and rescue and emergency equipment. e. Procedures for evaluating permit space conditions when entry operations are conducted (testing and monitoring). f. Procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and for preventing unauthorized personnel from attempting a rescue.

29 CFR  1904.29(b)(1): What do I need to do to complete the OSHA 300 Log? You must enter information about your business at the top of the OSHA 300 Log, enter a one or two line description for each recordable injury or illness, and summarize this information on the OSHA 300-A at the end of the year.  a) On or about May 1, 2022, the employer did not ensure that case number 4 on the employer's OSHA 300 form for 2022 contained a complete description of the object/substance that directly injured or made the person ill. b) On or about May 10, 2022, the employer did not ensure that case number 5 on the employer's OSHA 300 form for 2022 contained a complete description of the object/substance that directly injured or made the person ill.
